Sold a house, land or building and facing a big capital-gains tax bill? Section 54EC bonds let you legally avoid that tax by parking the gains in government-backed bonds.
How it works, step by step:
- You sell an immovable property held over 2 years → long-term capital gain arises.
- Within 6 months of the sale, invest the gain amount in 54EC bonds issued by REC, PFC or IRFC (all government-backed, AAA-rated).
- That invested gain becomes fully exempt from capital-gains tax.
The fine print you must know:
- Limit: ₹50 lakh per financial year. Gains above that are taxed normally (or use Section 54 by buying another house).
- Lock-in: 5 years. You cannot sell, pledge or take a loan against them — doing so cancels the exemption.
- Interest ~5.25% per year, paid annually — and this interest is taxable at your slab.
- Applies to gains from land/building only, not shares or mutual funds.
Should you use them? Compare with paying 12.5% LTCG tax and investing the rest freely. For most sellers in the 30% bracket who value certainty, 54EC is excellent for the first ₹50L of gains; beyond that, weigh reinvestment options.
